Terms of Service

These terms are the agreement between you and Codezun for the use of Petnote. They are written to be read rather than to be survived, but they are still the contract — the parts that limit what you can claim from us are as binding as the parts that say what we do.

1. The agreement

Petnote (“the service”) is operated by Codezun, established in Honduras(“we”, “us”). By creating an account or using the service you accept these terms. If you do not accept them, do not use the service.

The Privacy Policy, the Cookie Policy and the Refund Policy form part of this agreement. Where the Refund Policy addresses a payment question, it governs.

You must be at least 18 years old, or the age of majority where you live if that is higher, and legally able to enter into a contract.

2. What Petnote is not

Petnote is a record-keeping tool. It is not veterinary advice, diagnosis or treatment, and it is not a medical device. Nothing in the service — not a reminder, not a due date, not a weight chart, not the absence of a warning — is a clinical judgement about your animal. Always consult a qualified veterinarian, and in an emergency contact one immediately rather than consulting an app.

Reminders and due dates are calculated from what you enter. They are a convenience, offered on a best-effort basis. They are not an alerting system and must not be relied on for anything time-critical: an email can be delayed, filtered, bounced or never sent, and a date you typed wrongly will be repeated back to you wrongly.

3. Your account

You are responsible for your account: for the accuracy of what you put in it, for keeping your password to yourself, and for everything done through it. Tell us at codezun@gmail.com promptly if you believe someone else has access.

One account per person. Do not share credentials, and do not create an account on behalf of someone else without their authority.

4. Your content

Everything you put into Petnote — pet profiles, records, photographs, uploaded documents, notes, contact details — remains yours. We claim no ownership of it.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, adapt for technical purposes and display that content, strictly as needed to operate the service for you. That includes publishing the specific fields you have chosen to publish through Emergency Mode. The licence exists so we can run the product; it ends with respect to any content when you delete it.

You confirm that you have the right to upload what you upload, and that it does not:

  • infringe anyone's intellectual property or privacy rights;
  • contain another living person's personal data without a lawful basis for putting it there — the emergency contact and veterinarian details you enter are the obvious case, and it is your responsibility to have their agreement;
  • break any law that applies to you.

5. Emergency Mode

Emergency Mode publishes a page at an unlisted address, reachable by anyone holding the link or the QR code. Turning it on is your decision and publishing is its entire purpose.

An unlisted address is not a secret one. A printed tag can be photographed, a link can be forwarded, and a URL can be guessed at by someone determined enough. Treat everything on that page as public, and do not put anything on it you would not put on a noticeboard.

What appears there is a fixed, narrow set of fields: the pet's name, photograph, species and breed, allergies, current medications, and the owner, emergency contact and veterinarian details you have entered. Medical history, weight entries, documents and notes are never included. We ask search engines not to index these pages, which they generally respect, but we cannot guarantee the behaviour of every crawler or archive.

You can switch the page off at any time, and you can issue a fresh code — which immediately and permanently retires the previous one, along with every tag already printed with it. We are not liable for the consequences of information you chose to publish, nor for a page being unreachable at a moment you needed it.

6. Acceptable use

You agree not to:

  • use the service for anything unlawful, or to store unlawful content;
  • attempt to access another account, another person's data, or any part of the system you have not been granted access to;
  • probe, scan or test the security of the service without our prior written permission — if you have found something, report it to codezun@gmail.com and we will thank you for it;
  • scrape, crawl or bulk-download the service, or use automated means to create accounts or generate requests beyond normal use;
  • resell, sublicense or make the service available to third parties as your own, or circumvent plan limits;
  • reverse engineer, decompile or attempt to derive source code, except to the extent that restriction is unenforceable where you live;
  • upload malware, or anything designed to disrupt the service or its users.

7. Plans, billing and changes

The service has a Free plan and a paid plan, Pro. What each includes is described on the pricing section and in the app, and we may change what a plan includes. If a change materially reduces what you are paying for, you may cancel; the Refund Policy governs what happens to money already paid.

Subscriptions renew automatically until cancelled. Payments are handled by Paddle as merchant of record. We do not issue refunds — see the Refund Policy, which is part of these terms and explains that rule and the rights it cannot override.

Prices may change. A change takes effect at your next renewal, never mid-period, and we will tell you before it does.

8. Availability, and keeping your own copies

We work to keep the service running and your data intact, but we offer no uptime commitment and no service level agreement. The service is provided on an “as is” and “as available” basis. It may be interrupted for maintenance, by a failure at one of the providers we depend on, or without warning.

Keep your own copies of anything that matters. Petnote is a convenient place to keep your pet's records; it is not an archive of record and it is not a backup service. Vaccination certificates, laboratory results and anything a vet, a border or a boarding kennel may demand should exist somewhere other than here as well.

9. Suspension and termination

You may stop using the service at any time and delete your account from Settings. Deletion is immediate and irreversible: it removes your profile, your pets, every record under them, and your stored files. We cannot recover a deleted account.

We may suspend or terminate an account that breaches these terms, that is being used unlawfully, or where we are required to by law. Where it is reasonable to do so we will warn you first. Termination for breach does not entitle you to a refund.

Deleting your Petnote account does not cancel a Paddle subscription. Cancel the subscription first, from Plan & billing.

10. Disclaimer of warranties

To the fullest extent permitted by law, we disclaim all warranties, conditions and representations of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the service will be uninterrupted, timely, secure or error-free, that reminders will arrive, that stored content will not be lost, or that the service will meet your requirements.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, nor for loss of profit, loss of data, loss of goodwill, or veterinary, boarding, travel or other costs — however caused, and whether or not we were told such loss was possible.

Our total aggregate liability arising out of or relating to the service is limited to the greater of the amount you actually paid us in the twelve months before the event giving rise to the claim, or USD 50.

This includes, without limiting the generality of the above, any claim arising from a missed or delayed reminder, an inaccurate record, a lost or unreachable Emergency Mode page, information disclosed through a page you chose to publish, or the loss or corruption of stored content.

Nothing here excludes liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, for fraud, or any right you have as a consumer that cannot be waived. Where a limitation above is unenforceable in your jurisdiction, it applies to the maximum extent that is enforceable, and the rest of this clause stands.

12. Indemnity

You agree to indemnify and hold us harmless against claims, damages, liabilities and reasonable costs arising from content you uploaded or published, from your use of the service, or from your breach of these terms or of anyone else's rights.

13. Changes to these terms

We may update these terms. Material changes will be announced by email or in the app before they take effect, and the date at the top of this page will change. Continuing to use the service after that means you accept the updated terms; if you do not, stop using the service and delete your account.

14. General

These terms are governed by the laws of Honduras, and the courts there have exclusive jurisdiction over any dispute — without depriving you of the protection of mandatory law, or of the courts available to you, in the country where you habitually reside.

If any provision is held unenforceable, it is severed and the rest continues in force. Our not enforcing a provision on one occasion is not a waiver of it. You may not assign this agreement; we may assign it as part of a merger, acquisition or sale of assets. These terms, with the documents they incorporate, are the entire agreement between us on this subject.
